Refund Policy

for IT Development Services in the European Union

1. IntroductionThis Refund Policy is applicable to all IT development services provided by Stavitskii Management UG (limited liability) through the website makeweb.tech, in accordance with Directive (EU) 2011/83/EU on consumer rights, Regulation (EU) 2016/679 (GDPR), and applicable consumer protection laws within the European Union.

By purchasing services from our website, the Client agrees to this Refund Policy.
2. Nature of ServicesOur services involve customized IT development, which are made-to-order and delivered digitally. As such, they are excluded from the standard 14-day withdrawal period under Article 16(c) and (m) of Directive 2011/83/EU once execution has begun with the consumer’s prior express consent and acknowledgment that they lose their right of withdrawal.
3. No Refund Policy After CommencementOnce the Client has agreed to the service terms and the project has commenced, no refunds will be provided unless the Contractor fails to deliver the agreed services through its own fault.
4. Eligible RefundsA refund may be considered only under the following circumstances:

- Non-performance of agreed services due to the Contractor’s fault
- Services delivered are materially different from what was agreed in writing

All requests will be reviewed on a case-by-case basis.
5. Request ProcedureTo request a refund, the Client must contact us in writing via info@makeweb.tech within 14 calendar days of service delivery, clearly stating the reasons and attaching any relevant documentation.

We reserve the right to deny refund requests submitted after this period or lacking proper justification.
6. Refund ProcessApproved refunds will be processed to the original payment method within 14 business days. Any third-party transaction fees, currency conversion charges, or related banking costs will be borne by the Client.
7. Non-Refundable CasesRefunds will not be granted in the following cases:

- The Client changes their mind after project commencement
- Delays caused by the Client’s failure to provide input, content, or feedback
- Project cancellation for reasons not related to service performance
- Force majeure events
8. Consumer Rights NoticeThis policy does not affect any statutory rights that EU consumers may have under applicable laws. However, for custom digital services, the right of withdrawal does not apply once execution has begun with the Client’s express consent.
9. Governing Law and JurisdictionThis Refund Policy is governed by the laws of the European Union and the country in which the Contractor is legally established.

Any disputes shall be resolved amicably or referred to the competent courts in the relevant jurisdiction.
